1. Introduction

Welcome to Divine Apparitions. By accessing our website, using our services, or purchasing products (including custom software, 3D printed parts, apparel, or consulting), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Service-Specific Terms

Because we offer a wide range of services, specific terms apply to different projects:

A. Web Development & App Services

  • Intellectual Property: Upon full payment, the client is granted Non-Exclusive rights to the custom code created for their project. Divine Apparitions retains the right to reuse generic code libraries, snippets, and architectural patterns.
  • Warranty: We provide a 30-Day warranty period after launch to fix bugs related to our code. Issues caused by third-party plugins, hosting updates, or client modifications after launch are billed at our hourly rate.
  • Third-Party Services: We are not responsible for downtime, data loss, or breaches caused by third-party hosting providers (e.g., AWS, Pantheon) or API changes from external vendors.

B. Additive Manufacturing, CNC & DTF Printing

  • File Integrity: You are responsible for the quality and design of the files (STL, OBJ, Vector, etc.) you submit. We do not verify the structural integrity or engineering validity of your designs. We are not liable for parts that fail due to poor design.
  • Tolerances: By using our manufacturing services, you acknowledge that 3D printing, CNC machining, and DTF printing have inherent manufacturing tolerances. Minor cosmetic imperfections or slight dimensional variations (within industry standards) are not grounds for a refund.
  • Content Policy: We reserve the right to refuse to print or manufacture any content that is illegal, infringes on intellectual property rights, serves as a functional weapon, or is deemed offensive.
  • Abandonment: Custom items not picked up or shipped within [30] days of completion may be discarded without refund.

C. IT Consulting & Infrastructure

  • Advice Disclaimer: Our consulting services provide recommendations based on industry best practices. Divine Apparitions is not liable for data loss, hardware failure, or security breaches that occur despite our recommendations.
  • On-Site Work: For physical installations (cabling, networking), the client must provide safe and clear access to the workspace.

3. Payments & Refunds

  • Custom Projects: A 50% non-refundable deposit is required to begin work on all custom development and manufacturing projects. The remaining balance is due upon Completion/Delivery.
  • Refunds: Due to the custom nature of our services (software, printed parts, apparel), all sales are final. If a manufacturing error occurs that is clearly our fault, we will reprint or remake the item.

4. Limitation of Liability

To the fullest extent permitted by law, Divine Apparitions shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use of our services or products. Our total liability shall not exceed the amount paid by you for the specific service in dispute.
